DECISION

Defining the functions, tasks, powers and organizational structure of the Frequency Control Division

THE DIRECTOR GENERAL OF THE RADIO FREQUENCY DIRECTORATE

Pursuant to the Prime Minister’s Decision No. 88/2008/QD-TTg of July 4, 2008, defining the functions, tasks, powers and organizational structures of the Radio Frequency Directorate under the Ministry of Information and Communications;

At the proposal of the Chiefs of the Organization and Personnel Division and the Frequency Control Division,

DECIDES:

Article 1. Position and functions

The Frequency Control Division is a unit of the Radio Frequency Directorate and functions to advise and assist the Director General in controlling radio frequencies and inspecting radio devices (below referred to as control and inspection) and handling radio frequency interferences.

Article 2. Tasks and powers

The Frequency Control Division has the following tasks and powers:

1. To assume the prime responsibility for, and coordinate with other units of the Directorate in, formulating and submitting to the Director General for promulgation the Directorate’s regulations on and processes for control and inspection and radio frequency interference handling and guide their implementation.

2. To assume the prime responsibility for, and coordinate with other units of the Directorate in, formulating plans on control and inspection and interference handling by the Radio Frequency Directorate and submit them to the Director General for approval.

3. To propose to the Director General for approval professional operations to improve the quality and effectiveness of control and inspection and radio frequency interference handling and organize their implementation.

4. To assume the prime responsibility for elaborating, amending and supplementing the master plan on the technical radio control system to be submitted by the Radio Frequency Directorate to the Minister of Information and Communications for approval. To coordinate with other units of the Directorate in studying, formulating and making investment in technical equipment for these units.

5. To monitor, examine, urge and guide regional radio frequency centers in control and inspection and interference handling under law and the Radio Frequency Directorate’s regulations, processes and working plans. To review and report on the implementation of working plans on control and inspection and interference handling under the Directorate’s regulations.

6. To coordinate regional radio frequency centers in Vietnam-related international control and inspection and interference handling.

7. To join international cooperation activities, to prepare relevant contents for the World Radiocommunication Conference (WRC), Asia-Pacific Telecommunity (APT) conferences and study groups of the International Telecommunication Union (ITU) as assigned by the Director General.

8. To provide human resource, technical and equipment support and coordinate control and inspection and handling of interferences involving areas of different regional radio frequency centers and concerned sectors under the Directorate’s regulations.

9. To coordinate with the Inspectorate of the Radio Frequency Directorate in handling violations of regulations on use of radio frequencies and transmitting equipment under law.

10. To exploit the Directorate’s radio control system; to link the control database with the frequency assignment database of the Directorate; to monitor, inspect and review the radio control system status; to propose technical solutions to promote the effectiveness and utilities of equipment.

11. To propose and submit to the Director General for approval, guide and coordinate with provincial-level Information and Communications Departments in, radio frequency management in localities.

12. To act as the standing body of the sub-committee for interference handling under the Radio Frequency Committee.

13. To advise the Director General and monitor and urge units in flood prevention and control, safety assurance and rescue.

14. To manage cadres and civil servants, assets and dossiers and documents under law and the Director General’s power decentralization.

15. To perform other tasks and powers assigned by the Director General.

Article 3. Organizational structure

The Frequency Control Division has its Chief, Deputy Chiefs and cadres and civil servants.

The Chief shall take responsibility before the Director General and law for the performance of assigned functions, tasks and powers.

Deputy Chiefs shall assist the Chief in directing and administering affairs of the Division and take responsibility before the Chief and law for their assigned tasks.

The Chief shall assign tasks to cadres and civil servants of the Frequency Control Division.

Article 4. Effect

This Decision takes effect on the date of its signing. Previous regulations which are contrary to this Decision are all annulled.

Article 5. Implementation responsibilities

The Chiefs of the Organization and Personnel Division and Frequency Control Division and heads of units of the Radio Frequency Directorate shall implement this Decision.
