DECISION

Defining the functions, tasks, powers and organizational structure of the Planning and Investment Division

THE DIRECTOR GENERAL OF THE RADIO FREQUENCY DIRECTORATE

Pursuant to the Prime Minister’s Decision No. 88/2008/QD-TTg of July 4, 2008, defining the functions, tasks, powers and organizational structure of the Radio Frequency Directorate under the Ministry of Information and Communications;

At the proposal of the head of the Organization and Personnel Division and the head of the Planning and Investment Division,

DECIDES:

Article 1. Position and functions

The Planning and Investment Division is a unit under the Radio Frequency Directorate and functions to advise and assist the Director General in planning, investment and construction activities.

Article 2. Tasks and powers

The Planning and Investment Division has the following tasks and powers:

1. To elaborate and submit to the Director General for approval or for submission to a competent authority for approval revenue-expenditure estimates and long-term and annual investment and construction plans of the Directorate.

2. To submit to the Director General the allocation of annual plan targets and state budget estimates for its attached units.

3. To study and propose to the Director General the implementation of investment and construction regulations, and organize the implementation of, and inspect the Directorate’s units in observing, these regulations.

4. To make, and guide relevant units in making, investment and construction preparations. To elaborate, appraise, and carry out procedures to submit to competent authorities for approval of, projects, designs and cost estimates.

5. To organize bidding for engineering and equipment procurement under approved plans. To elaborate, appraise and submit for approval bidding plans, bidding dossiers, bid dossier evaluation criteria and bidding results.

6. To monitor and inspect the implementation of projects in terms of progress, quality and takeover test upon completion of works and observance of state management regulations in the process of investment and construction. To ask for the Directorate leadership’s instructions and guide units in settling problems arising in the process of investment and construction under current regulations.

7. To regularly evaluate, and make preliminary and final reports on, investment and construction work. To propose policies and measures to raise the quality and effectiveness of this work.

8. To seek funding sources for the Directorate’s development investment work.

9. To negotiate, and submit to the Director General the signing of, economic contracts. To perform, and guide the performance of, economic contracts on consultancy, procurement and construction under law.

10. To manage, use and develop, and guide the Directorate’s units in managing, using and developing, land funds under law.

11. To guide, monitor, urge and inspect the Directorate’s units in the registration and implementation of scientific and technological projects under annual plans.

12. To buy, and guide the Directorate’s units in buying, insurance for the Directorate’s assets and equipment.

13. To manage employees, assets, dossiers and documents under law and as decentralized by the Director General.

14. To perform other tasks and exercise other powers assigned by the Director General.

Article 3. Organizational structure

The Planning and Investment Division has the head, deputy heads and employees.

The head is answerable before the Director General and law for the performance of assigned functions, tasks and powers.

Deputy heads shall assist the head in directing and administering the Division’s work and are answerable before the head and law for assigned tasks.

The head shall assign tasks to the Division’s employees.

Article 4. Effect

This Decision takes effect on the date of its signing and replaces Decision No. 120/2003/QD-CTS-TCCB of September 29, 2003, of the Radio Frequency Directorate, defining the functions, tasks and powers of the Planning and Capital Construction Investment Division. All previous regulations which are contrary to this Decision are annulled.

Article 5. Implementation responsibility

The head of the Organization and Personnel Division, the head of the Planning and Investment Division and heads of units under the Radio Frequency Directorate shall implement this Decision.
