CIRCULAR
Regulation on the list of radio devices exempted from frequency license, together with their technical and operational conditions
Pursuant to Law on Radio Frequency dated on November, 2009;
Pursuant to Decree No. 71/2013/ND-CP of the Prime Minister dated on November 21, 2013 promulgate National Allocation Frequency Table;
Pursuant to Decree 132/2013/ND-CP dated on October 16th 2013 of the Government, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
At the proposal the Director General of Authority of Radio Frequency Management;
Minister of Information and Communications issues the Circular prescribing Regulation on the list of radio devices exempted from frequency license, together with their technical and operational conditions
Article 1. Scope
1. This Circular prescribes the list and the technical and operational conditions of radio devices exempted from radio frequency license.
2. This Circular applies to organizations and individuals that use, manufacture, import or trade radio equipments which are exempted from radio frequency license in Viet Nam.
3. This Circular does not apply to radio devices manufactured or imported for the purpose of national defense or security of the armed forces. The production, import and use of radio devices managemented by the Ministry of Defense, Ministry of Public Security shall ensure compliance with national technical regulations respectively.
Article 2. Explain the words
In this Circular, the words below are explained:
- Short Range Device: is intended to cover the radio transmitters which provide either unidirectional or bi-directional communication which have low capability of causing interference to other radio equipment.
- Non-Specific Short Range Device: Includes short range radio devices that meet technical and operational requirements, regardless of application or purpose of use.
- Cordless Phone: is the cordless telephone terminal connected to the public telephone network via analog two-wire interface. This device consists of two separate blocks are connected to each other via the radio interface:
The base unit is installed at a fixed position and connected to two fixed telephone lines of the public telephone network (PSTN: Public Switched Telephone Network); using an integral antenna. An integral antenna is a permanent fixed antenna installed inside or outside the unit as an indispensable part of the unit.
Mobile unit (one or more than one) is a hand-held unit using an integral antenna. The mobile unit carries the subscriber telephone number of the base unit.
- MICS-Medical Implant Communications Systems and MITS-Medical Implant Telemetry Systems
Medical Implant Communications Systems MICS) and Medical Implant Telemetry Systems (MITS) are systems each consisting of an implanted medical device and an external radio communications device used for the purpose of exchanging data with the implanted device within a distance of 2m; then the data will be transmitted to a processing center and to physical doctors via the telecommunications network.
In MICS, the implanted and radio communications devices exchange data in two ways. In MITS, data are transmitted only in one way from the implanted device to the radio communications device at programmed points of time.
- RFID-Radio Frequency Identification
Radio Frequency Identification Devices (RFID) use radio waves to automatically identify, monitor and manage goods, people and animals and perform other applications. Such a device consists of two distinct units linked via radio interface:
- RF tag carrying a chip, with or without a power source, attached to the to-be-identified object. A chip contains information on the target.
- RF Reader transmitting a certain frequency to activate the radio card and the radio card will transmit information contained in the card. Such information will be recorded by the reader and transmitted to a data processing system.
- RFID devices are used in distribution, transportation and retail, healthcare, transportation or mobile applications (smart advertising).
- Radio Detection and Alarm Device
Radio detection and alarm devices include sensors and control systems connected together via radio interface.
Some typical radio detection and alarm devices include theft, movement and metal detectors
- Wireless Audio Device
Wireless audio device includes include devices applying radio waves to transmit sounds or audio signals at a short range.
Some typical wireless audio device: include shirt-fastened cordless microphones, hand-held cordless microphones, cordless headphones, private FM transmitters and hearing assistance aids.
- Remote Control Device
Radio remote controls include those using radio waves to control models and industrial and domestic use.
Typical remote controls include controls of air models such as aircraft models, ground and water surface models such as car models and ship models, and industrial and civil control such as car- and garage-door openers.
- Wireless Local Area Network devices
Wireless Local Area Network devices (below referred to as WLAN devices) are used to establish radio local networks instead of using cable lines.
Typical WLAN devices include access point, wifi router and wifi card, The device incorporates an IEEE 802.11 compliant radio transceiver module (not including wireless equipment for connecting WLANs Wireless bridge)
- Radio telemetry
Radio telemetry devices automatically indicate or record measurements and control functions of other devices via radio interface
- Wireless video transmitters
Wireless video transmitters are used to transmit image data to processing system via radio interface.
Typical wireless video devices include wireless webcam, wireless camera and wireless video devices via USB port interface from the computer.
- Radio device placed on fishing boat
Radio device placed on fishing boat are used for communication between fishing boats operating in the waters of Vietnam.
- Receiver only radio device is radio device which has the function of receiving radio signals
- Broadband data transmission device is a wireless device used for broadband transmission in the IMT-Advanced mobile network (LTE-Advanced and the next) using the 5150-5350 MHz band, 5470-5850 MHz band width a minimum bandwith of 20 MHz or for speed access to Gigabit/s in wireless local area network (WLAN), wireless personal area network (WPAN) within the band 57-66 GHz.
- Automotive Radar is short range radar device for use in traffic information applications such as cruise control, detection, warning and avoidance of collisions between vehicles and objects.
- Low-power radio communication device is a mobile end-to-end wireless device capable of receiving and transmitting voice signals within a limited area (for ex, a building, a campus).
- UWB-Ultra Wide Band Communication Device is short range radio device for transmitting information in the GHz frequency band with signal bandwidths above 500 MHz.
- Inductive Loop is a device with signal transmission function, based on the principle of electromagnetic field and using low frequency.
- AIS-Automatic Identification System is a radio device used in maritime safety systems installed for use on ships, boats and other motor or non-motor means to improve maneuverability and impact management facilitate operation on water or underwater.
- EPIRB-Emergency Position Indicating Radio Beacon is an emergency location radio device that uses the 406-406.1 MHz frequency band, which is installed and used on vehicles operating on water or under water, including ships and boats. Other motor or non-motor.
- SART-Search and Rescue Radar Transponder is a marine rescue radio device operating in the 9 GHz band.
- Automatic Identification System - Search and Rescue Radar Transponder (AIS-SART) is a radio radio of the marine device support group for search and rescue agencies to locate life-saving equipment or boats in search and rescue operations.
Article 3. The list of radio devices exempted from frequency license, together with the technical and operational requirements
- The list of radio devices exempted from frequency license (below referred to as The list) specified in Appendix 1 together of this Circular.
- The technical condition and exploitation of radio devices exempted from frequency license specified from Appendix 2 to Appendix 19 of this Circular.
Article 4. The exempted from radio frequency license
Radio device of The list meets the general conditions in Article 5 and the technical conditions and exploitation in the corresponding from Appendix 2 to Appendix 19 of this Circular exempted from frequency license
Article 5. General conditions
The following conditions apply generally to radio devices exempted from frequency license:
- The license exempted radio devices must tolerate any interference caused by radio devices which granted a radio license, and the radio devices that are permitted to operate by management agencies
In the case of the license exempted radio devices cause harmful interference, organizations and individuals shall immediately stop their operation and just resume their operation after the interference has been resolved.
- The license exempted radio devices must tolerate any interference caused by the industrial, scientific and medical (ISM) equipment by sharing the following frequency bands used for ISM purposes:
a) Frequency band 13.553 ÷ 13.567 MHz;
b) Frequency band 26.957 ÷ 27.283 MHz;
c) Frequency band 40.66 ÷ 40.70 MHz;
d) Frequency band 2400 ÷ 2483.5 MHz;
e) Frequency band 5725 ÷ 5875 MHz;
f) Frequency band 24000 ÷ 24500 MHz.
- Organizations and individuals that manufacture, import the license exempted radio devices shall also comply with the provisions of the law on the import, certification and conformity announcement, ensure the device in accordance with technical and operational requirements specified in the Appendixs of this Circular.
- Organizations and individuals that exploit and use equipment incorporating radio remote control functions in airplane models must comply with the provisions of law on licensing air operations.
- Organizations and individuals that manufacture, import the license exempted radio devices shall also comply with the provisions of the law on telecommunications, radio frequencies and other relevant laws; Do not use the information obtained for illegal purposes.
Article 6. Takes effect and Transitional terms
- Radio device that meets the requirements of Circular No. 03/2012/TT-BTTTT March 20, 2012 of the Ministry of Information and Communications "Stipulating the list of radio devices exempted from frequency license, together with the technical and operational requirements", which are no longer suitable to this Circular, may continue to be used but must be discontinued when causing harmful interference to radio device granted the license.
- Radio communication device of low power on the list in Appendix 1 of this Circular, according to the conditions of frequencies, technical and operational specified in Appendix 2 and Appendix 18 to this Circular to exempt radio frequency use licenses from January 1, 2020.
- No authorize for the deployment of new radio device using the 446-446.2 MHz band with power of over 500 mW from the effective date of this Circular.
Article 7. Executive terms
1. This Circular takes effect from 14 february 2017 and replaces Circular No. 03/2012/TT-BTTTT March 20, 2012 of the Ministry of Information and Communications "Stipulating the list of radio devices exempted from frequency license, together with the technical and operational requirements
2. The director of the Ministry’s Office, the general director of the Authority of radio frequency management, heads of agencies and offices under the Ministry of Information and Communications, and organizations and individuals are responsible for the implementation of this Circular.
3. Any problem encountered in the process of implementation should be promptly reported to the Ministry of Information and Communications for consideration, amendment or supplementation./.

In the table above, the types of Channels are defined as follows:
- Safety and rescue channel is dedicated channel for information safety and rescue.
- Communication channel is channels for communication and exchange of information.
- Call channel is a dedicated channel for establishing a call.
Note 2:
1.1. Condition of using safety and rescue channel
1.1.1. In case of emergency, danger to life and marine facilities, in addition to using channel 9 (reserved for safety and rescue information), organizations and individuals to submit information or signals research can also transmit to attract attention on whatever channel of the frequency channel arrangement table.
1.1.2. Upon receiving the information, the emergency signal, the radio station must immediately stop broadcasting on frequencies that may cause interference to emergency information and must listen constantly on emergency frequency, reply and implement all necessary assistance immediately and notify search and rescue agencies.
1.2. Condition of using call channel
1.2.1. Call channel (channel 11 and channel 19) is only used to set up calls between fishing boats.
1.2.2. Call channel is used only for a maximum period of 1 minute. Call station give name can call the name of the station being called (repeated 3 times) on the call channel. after receiving the response of the the called station, call station specifies the communication channel to two stations switched to the same channel at the communication channel. Do not communicate at call channel.
1.3. Condition of using communication channel
1.3.1. Communication channel is selected from among 37 channels of the frequency channel arrangement Table (except safety, rescue and call channel). In the process of working, can be converted to other communication channels to avoid interference if have interference due to other sations.
1.3.2. Communication channel is only used for a period of up to 5 minutes, in case of extending contact, after 5 minutes, must pause for a minute before continue to contact
1.4. The prohibited acts:
1.4.1. Using power that excess the transmit power limit specified in point 3 of this Annex.
1.4.2. Causing harmful interference to safety and rescue channel.
1.4.3. Using safety and rescue channel for the purpose of establishing the call and contact.
1.4.4. Using call channel for the purpose of communicating (except emergency information).
1.4.5. Occupying the communication channel continuously than 5 minutes or transmitting any carrier that alternate between calls.
1.4.6. Transmitting call signal, identification signal continuously, repeating on call channel that exceeding 1 minute.
1.4.7. Transmitting identification signal simultaneously on two or more frequencies if only contact with another station.
