DECISION

Defining the functions, tasks, powers and organizational structure of the Organization and Personnel Division

THE DIRECTOR GENERAL OF THE RADIO FREQUENCY DIRECTORATE

           Pursuant to the Prime Minister’s Decision No. 88/2008/QD-TTg of July 4, 2008, defining the functions, tasks, powers and organizational structures of the Radio Frequency Directorate under the Ministry of Information and Communications;

At the proposal of the Chief of the Organization and Personnel Division,

DECIDES:

Article 1. Position and functions

          The Organization and Personnel Division is a unit of the Radio Frequency Directorate and functions to advise and assist the Director General in the domains of organization, personnel, training, development of human resources, labor and wages.

Article 2. Tasks and powers

The Organization and Personnel Division has the following tasks and powers:

          1. To elaborate the functions, tasks, powers and organizational structures of the Radio Frequency Directorate, and Centers and the Inspectorate of the Directorate for the Director General’s submission to the Minister of Information and Communications. To elaborate and submit to the Director General for decision the functions, tasks and powers of the Office and divisions of the Directorate.

          2. To formulate and implement the organization and personnel planning and regulations on cadre and civil servant management; wage and bonus distribution; training; and management of overseas trips of the Directorate’s cadres and civil servants, and other regulations related to cadres and civil servants, labor and wages.

          3. To develop a system of titles and professional standards for the Directorate’s cadres and civil servants.

          4. To assume the prime responsibility for, and coordinate with units of the Directorate in, proposing and carrying out procedures for the transfer, appointment, relief from duty, rank promotion and transfer, disciplining, dismissal and resignation of the Directorate’s cadres, civil servants, public employees and contractual employees under law.

          5. To elaborate payroll limits for titles, recruitment plans and training plans for each year and period based on the Directorate’s management tasks. To implement plans on examination for recruitment of civil servants and public employees and plans on training and refresher training of the Directorate’s cadres and civil servants.

          6. To study and propose the wage arrangement and raising and guide the implementation of regulations on wages and bonuses for civil servants, public employees and other employees of the Directorate. To calculate wages, bonuses and other wage-based incomes for cadres, civil servants, public employees and other employees of the Directorate.

          7. To implement social and health insurance regimes for cadres and civil servants and other employees of the Directorate. To propose other insurance regimes for cadres, civil servants and other employees of the entire Directorate.

          8. To study, elaborate and propose regimes and policies for civil servants, public employees and other employees of the Directorate. To guide and examine units of the Directorate in implementing policies and regimes of the State and the Directorate for civil servants, public employees and other employees.

          9. To assume the prime responsibility for, and coordinate with units of the Directorate in, sending their personnel abroad for work, study, study tour or survey.

          10. To assume the prime responsibility for guiding the commenting and evaluation of cadres, civil servants, public employees and other employees under regulations.

          11. To ensure internal political protection.

          12. To assume the prime responsibility for, coordinate with, guide and examine units of the Directorate in labor safety and sanitation and fire and explosion prevention and control.

          13. To manage and preserve records of civil servants, public employees and other employees of the Directorate under law.

          14. To manage cadres and civil servants, assets, dossiers and documents under law and the Director General’s power decentralization.

          15. To perform other tasks and powers assigned by the Directorate Director.

Article 3. Organizational structure

The Organization and Personnel Division has its Chief, Deputy Chiefs and cadres and civil servants.

The Chief shall take responsibility before the Director General and law for the performance of assigned functions, tasks and powers.

Deputy Chiefs shall assist the Chief in directing and administering affairs of the Division and take responsibility before the Chief and law for their assigned tasks.

The Chief shall assign tasks to cadres and civil servants of the Organization and Personnel Division.

Article 4. Effect

          This Decision takes effect on the date of its signing and replaces the Radio Frequency Directorate Director’s Decision No. 115/2003/QD-CTS-TCCB of September 29, 2003, defining the functions, tasks and powers of the Organization and Personnel Division. Previous regulations which are contrary to this Decision are all annulled.

          Article 5. Implementation responsibilities

The Chief of the Organization and Personnel Division and heads of units of the Radio Frequency Directorate shall implement this Decision.-
