Position and functions of The Region Radio Frequency Center

THE MINISTER OF INFORMATION AND COMMUNICATIONS

          Pursuant to the Government’s Decree No. 187/2007/ND-CP of December 3, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

          Pursuant to the Prime Minister’s Decision No. 88/2008/QD-TTg of July 4, 2008, defining the functions, tasks, powers and organizations structure of the Radio Frequency Directorate under the Ministry of Information and Communications;

At the proposal of the director of the Organization and Personnel Department and the Director of the Radio Frequency Directorate,

DECIDES:

Article 1. Position and functions

          The Region Radio Frequency Center is a unit under the Radio Frequency Directorate which shall assist the Director of the Directorate in performing the state management of radio frequencies.  

          The Region Radio Frequency Center has the legal person status and its own seal and account for transactions according to law.

Article 2. Tasks and powers

The Region Radio Frequency Center has the following tasks and powers:

          1. To provide professional guidance to and coordinate with provincial-level Information and Communications Departments and relevant state management agencies in the localities under its management in performing the radio frequency management;

          2. To examine and guide the observance of law and state regulations on frequency management by organizations and individuals that use radio frequencies and frequency transmitters in localities under its management;

          3. To receive and guide applicants for radio frequency licenses to comply with procedures and complete dossiers as prescribed and perform some tasks of frequency assignment and licensing under the assignment and decentralization of the Radio Frequency Directorate;

          4. To control the transmission of radio frequencies by domestic broadcast stations and foreign stations broadcasting to Vietnam in the localities under its management according to Vietnam’s law and treaties to which Vietnam is a contracting party;

          5. To measure radio frequency parameters of broadcast stations and other radio frequency transmission sources. To summarize control and measurement data for the management of radio frequencies;

          6. To inspect the operation of, and examine licenses and certificates granted to,  radio frequency transmitters installed on board foreign aircraft, seagoing vessels and other vehicles which enter or anchor at airports, seaports or parking stations in localities under its management;

          7. To participate in international programs on control of radio frequency transmission and technical and professional activities organized by the International Telecommunication Union (ITU) and other relevant international organizations under regulations of the Radio Frequency Directorate;

          8. To detect and handle violations of the law on radio frequency committed in localities under its management according to law;

          9. To investigate and identify sources of interference and handle harmful interference according to law; to suspend operation of radio frequency transmitters of organizations and individuals that violate regulations on the use of radio frequencies and cause harmful interference under the decentralization of the Radio Frequency Directorate; to compile dossiers for the Radio Frequency Directorate to lodge complaints about interference caused by foreign parties to Vietnam’s radio frequency operations in localities under its management according to international regulations;

          10. To participate in the elaboration, amendment and supplementation of documents on radio frequency management;

          11. To collect radio frequency charges and fees and other revenues as assigned by the Radio Frequency Directorate;

          12. To manage its organizational apparatus, cadres, public servants, properties, dossiers and documents according to law, the Ministry of Information and Communications’ regulations and the Radio Frequency Directorate’s decentralization;

          13. To perform other tasks and exercise other powers as assigned by the Director of the Radio Frequency Directorate.

Article 3. Organizational apparatus

The Region Radio Frequency Center has a director, a deputy-director and an assisting apparatus.

          The director of the Region Radio Frequency Center shall take responsibility before the director of the Radio Frequency Directorate and law for the performance of the functions, tasks and powers defined in this Decision.

          The deputy-director shall assist and take responsibility before the director and law for his/her assigned tasks.

          Functions, tasks and working relations of units under the Center shall be formulated by the Center Director for submission to the Director of the Radio Frequency Directorate for decision.

          The number of civil servants, public employees and laborers of the Center shall be proposed by the Center Director to the Director of the Radio Frequency Directorate for decision on the basis of payroll norms of the Radio Frequency Directorate assigned by the Minister of Information and Communications.  

Article 4. Effect

This Decision takes effect on the date of its signing. Previous regulations which are contrary to this Decree are all annulled.

Article 5. Implementation responsibility

          The director of the Radio Frequency Directorate, the director of the Office, the director of the Organization and Personnel Department, heads of units under the Ministry and the Director of the Region Radio Frequency Center shall implement this Decision.
